What Should I Do To Pursue A Personal Injury Claim?

We use a number of criteria in order to help you determine if you should pursue a personal injury claim.  There is no standard approach to a personal injury case, but here are a few things to keep in mind when deciding to file suit:

  • Document your injury and losses: It’s important to write down as many details as the accident as you can, including how it happened, why it happened, who was there when it happened, and what loses you have sustained as a result of the accident.
  • Are you within your statue of limitations?: Generally, statues of limitations on cases involving personal injury can range from as short to 30 days to up to a year; when filing your claim, you must also make sure you include required information in order to make sure you don’t lose your right to compensation.
  • Notify those who might be at fault for your injury: Write a short letter to anyone who might be at fault for your injury, it should only include basic information and a request for a written response.  It’s important to ask early, as the longer you wait, the more likely the at-fault party could say that they were surprised by this potential claim which will hurt your chances of recovering compensation
  • Locate those who witnessed your accident: Finding potential witnesses for your case will strengthen the likelihood that you will be able to receive a settlement for your case, or at least prove that you have been injured due to someone else’s negligence.  Time is of the essence as it will be harder to remember witnesses as time passes.
